The fact of the matter is that no where on the left is there a organized political machine remotely as significant as Fox News is on the right. MS NBC Kenneth Olbermann, Chris Matthews--nuff said. Keith Olbermann, Chris Matthews, and Rachel Maddow (You didn't mention her but she's in the same vein) are 3 one hour long shows on MSNBC, only on weekdays, and Matthews consistently has people on he disagrees with and unlike some other TV talking heads doesn't cut off their mics when they disagree with him. Fox News is a 24/7 conservative mouth piece that presents itself as "fair and balanced" news.

Striking down unconstitutional legislation, aka "legislating from the bench", has been the job of the judiciary since 1803. Without this, we would have segregated schools (Brown v. Board of Education, 1954), birth control would be illegal (Griswold v. Connecticut, 1965), the government could control reproduction (Roe v. Wade, 1973), and homosexuals could be thrown in jail (Lawrence v. Texas, 2003). Heck, the Supreme Court ruled a law restricting gun ownership unconstitutional earlier this year (District of Columbia v. Heller, 2008). Also this is basically what I wanted to say about the "activist judges" thing earlier. The whole concept of "activist judges" only makes sense if you don't understand the judicial branch.
